Abstract

The penal system of Spanish Law is living a serious crisis. Among other defects, all the weaknesses that jurisdictional way presents solving penal disputes are specially showed. In this context, convinced that it is an appropriate tool to solve crimes and misdemeanors, we bet on criminal mediation. Therefore, we study its concept and characte-ristics, highlighting advantages that shows solving disputes. However, this extrajurisdictional technique has not a complet, systematic and consistent regulation in our legal system, though, it is necessary, in our opinion. In order to encourage the legislature to make this work, and to facilitate his task, this article aims to study how is regulated this conflict resolution method in France..
