Abstract
The current Publicity Law implementation scheme can be issued into three levels. Firstly the laws delivered by the European Union, secondly those delivered by the State and finally those passed by the Autonomous governments empowered to do so. Actually, the State’s General Publicity Act passed on the 11th of November of 1988, besides addressing unlawful publicity, it addresses as well the legal tools to reinforce actions to correct and ban unlawful publicity. Also, quite recently, two laws have been passed changing so many sections of the aforementioned Publicity Act. The first one is the 39/2002 Law of October the 28th , which issues a collective legal action to protect some non specific consumers’ interests (see the 29th section of the General Publicity Act). The second, the 1/2004 Orga-nic Law, protects women against gender violence, and focuses on those kinds of publicity which degrade female images. Finally, the 2005 Tobacco Law issued on the 4th of May, which bans the publicity, promotion and protection of all tobacco products in all kind of media.
