Abstract

This paper analyzes the arbitration that the Act 3/2012 of July 6 introduced in the article 82.3 of the Workers Statute Act. In our opinion this arbitration is public and mandatory. Such characteristics make it contrary to the Spanish Constitution for violating the right to union association and the right to bargain collectively. Notwithstanding, in 2014 and 2015, the Constitutional court has declared the conformity of this arbitration. Consequently, and because of the writ of the article 10 of the Spanish Constitution, this paper search the protection of the two rights cited above in the international level.
