Abstract

Individualism, the diversity of family models, the continuous aging of the population and the new conceptualization of heritage are shaping Basque society in the 21st century. The need to adapt Basque civil law to this new reality is undeniable and, to this end, it is essential to address this challenge from different disciplines, analyzing the law on its own terms and identifying the needs of Basque society, that is, combining the legal perspective with the sociological one. In this sense, the study proposes a mixed methodology of analysis of notarial documents and court rulings and interviews with the professionals who have participated in the drafting and application of the law, as well as with Basque society. The empirical analysis contributes to the in-depth review of the current Law 5/2015, of June 25, on Basque Civil Law and to the analysis of its social effectiveness, as well as, in its case, to the elaboration of a future legislative proposal to the Basque Parliament.
