Abstract

Subsidiary protection has been considered as a second level international protection statute in the European Union, and specially in Spain. Among the conditions necessary to qualify for that statute, the consideration of the internal armed conflict has not been systematically and effectively applied to countries like Colombia, regarding the subsidiary protection. A territorial perspective and the capacity of armed actors to inflict serious harm, along with the capacity of the state to protect its citizens are fundamental elements to consider while interpreting the legal concept in a broader way and to include further internal armed conflicts inside the statue of subsidiary protection.
